1. General provisions

1.2. These Terms and Conditions (T&Cs) define the rules for using the Store, placing orders, providing services, selling digital products, and the rights and obligations of the Seller and the Customer.

1.3. The Store offers the sale of: • online services (e.g., consultations, hypnotherapy sessions, trance sessions), • digital products (e.g., e-books, templates, graphics, audio materials).

1.4. The language governing the agreement between the Seller and the Customer shall be Polish or English, and the governing law shall be the law of England and Wales (UK law).

2. Definitions

• • Seller / Service Provider – MS Hypnotherapy, Mariola Sztwiertnia (sole trader).
• • Customer / User – a natural person, company, or organization using the Store’s services.
• • Store – the website www.mshypnotherapy.com, through which the Customer can enter into agreements.
• • Digital Product – a file, e-book, audio material, template, graphic, or other digital content provided electronically.
• • Service – a consultation, online session, or other form of assistance provided by the Seller.

3. Scope of activity

3.1. The Store sells:

• • online services (consultations, hypnotherapy sessions, trance sessions),
• • digital products (e-books, templates, graphics, audio materials).

3.2. Services are provided after prior contact with the Customer and scheduling a convenient time.
3.3. Digital products are delivered after contacting the Seller and confirming payment.

4. Placing orders and payments

4.1. Orders can be placed via: • shop website • contact form, • email, • direct communication (e.g., message).

4.2. Payments can be made via:

• • PayPal,
• • Revolut, Monzo

4.3. All prices include VAT (if applicable).

4.4. The Customer will receive an order confirmation electronically.

5. Service execution and delivery of products

5.1. Services are performed after agreeing on a time and payment confirmation.
5.2. Digital products are delivered electronically (e.g., via link, email, or transfer).
5.3. The Customer receives access to purchased materials after the payment is processed.

6. Right of withdrawal

6.1. Under the Consumer Contracts Regulations 2013, a consumer has the right to withdraw from a distance contract within 14 days, except when:

• • a digital product has already been delivered or downloaded,
• • a service has been fully provided with the Customer’s consent.

6.2. Upon downloading or delivery of a digital product, the Customer loses the right of withdrawal.
6.3. If a service starts before the 14-day withdrawal period expires, the Customer consents to its execution and acknowledges loss of the right to withdraw.

7. Complaints and refunds

7.1. In case of defective digital product or inability to download, the Customer may submit a complaint via email.
7.2. Complaints should include: Customer details, order number, and a description of the issue.
7.3. The Seller will review the complaint within 14 business days.
7.4. If the complaint is justified, the Customer will receive a replacement file or a refund.

8. Customer account

8.1. Purchases can be made without creating an account.
8.2. The Customer is responsible for the accuracy of the data provided when placing an order.

9. Newsletter and marketing

9.1. Customers may subscribe to the newsletter voluntarily.
9.2. They may unsubscribe at any time via the “unsubscribe” link or by contacting the administrator.

10. Personal data

10.1. The data controller is MS Hypnotherapy (Mariola Sztwiertnia).
10.2. Data is processed in accordance with UK GDPR and the Privacy Policy available on the website.
10.3. Data may be shared with cooperating entities (PayPal, Revolut, Google, Meta, hosting).

11. Final provisions

11.1. These Terms and Conditions are effective from the date of publication on the website.
11.2. The Seller reserves the right to amend the Terms, informing Users in advance.
11.3. Matters not regulated by these Terms are governed by UK law.
11.4. Any disputes shall be resolved by the courts having jurisdiction over the Seller’s registered address.
